Just two weeks after Jay went missing, a fellow student, Timothy Herrington Jr., was charged with murder in connection to Lee’s disappearance. The police connected Herrington to Lee through surveillance footage, and they even found bodily fluids that could potentially link him to the case. It’s worth noting their relationship was described as intimate, adding a layer of complexity to an already heart-wrenching situation.

Fast forward to 2023, Herrington found himself indicted on capital murder charges. And while most people might think a homicide case without a body could be a lost cause, criminal defense attorney Blake Ballin disagrees. “The fact that a body hasn’t been found does make things trickier for prosecutors, but it certainly does not make it impossible,” he explained. However, as Ballin highlights, the absence of Jay’s body means that the case to prove his death becomes a complicated puzzle. “You have to ask: How do we know this person is missing? What is the proof that this person is even deceased?” These tough questions are expected to hang heavily in the air as the trial approaches, set for December 2.

Current Status of Timothy Herrington

While the legal process unfolds, Herrington is currently out on bond, which raises eyebrows among those following the case. His legal team is pushing for a jury from outside the local area, arguing that it would be impossible to find someone impartial in the county. As of now, there hasn’t been a decision made on that motion, but all eyes are on the court as it navigates this extremely sensitive matter.
